Matrimonial Causes Act 1973.

Under this legislation, the courts have incredibly wide discretion to redistribute your assets

regardless of whose name they are in to achieve a “fair” outcome. While the Act aims for

fairness, a courtroom battle over what “fair” means can lead to stress, high costs, and emotional

strain. A prenup allows you, rather than a court, to define what fairness looks like for your

unique partnership.

How Prenups Found Their Footing: The Landmark Radmacher Case

For a long time in English legal history, prenups were deemed contrary to public policy and

were practically “not worth the paper they were written on.” That all changed in 2010 with the

landmark Supreme Court case of Radmacher v Granatino.

In this case, the court ruled that decisive weight should be given to a prenuptial agreement that

is freely entered into by both parties, provided both had a full appreciation of its implications,

and it is fair to hold them to it. While prenups are still not automatically legally binding in the

UK, the Radmacher ruling shifted the landscape entirely. Today, if structured correctly with

professional legal guidance, a court is highly likely to uphold your agreement.
